Divorce Appraisals in the Charleston Metro Area

A divorce appraisal is a certified real estate appraisal that establishes a defensible opinion of a property's market value for use in dividing marital assets. For many couples, the marital home is the largest shared asset, and an independent valuation helps both parties, their attorneys, and the court work from a common, documented figure. At SC Real Estate Appraisals, we provide impartial, clearly supported valuations and handle each assignment with discretion and respect for a difficult time.

    Understanding Divorce Appraisals

A divorce appraisal answers a specific question: what is the market value of this property? The appraiser develops an independent opinion based on the property's characteristics and recent comparable sales, then documents the analysis in a written report. The appraisal establishes value, it does not decide how assets are divided, and appraised value is not the same as equity or a final buyout amount. How the value is used in your settlement is a decision for you, your attorneys, and the court.

How an Appraisal Supports Property Decisions

When spouses need to decide whether to sell a shared property or arrange a buyout, a documented value gives both sides a neutral starting point. If the property will be sold, the appraisal helps frame expectations for the proceeds. If one spouse will keep the home, the appraisal supports the conversation about compensating the other spouse for their share of the equity. A buyout figure depends on more than the appraised value alone, outstanding mortgage balances, other liens, and the terms negotiated between the parties all play a role, so the appraisal is one input into a broader financial decision, not the final number.

Independent Valuation and the Appraiser's Role

As certified appraisers, we are bound by the Uniform Standards of Professional Appraisal Practice (USPAP), which requires us to remain a neutral third party. We are not advocates for either spouse; we are advocates for a well-supported opinion of value. Our analysis examines the property's condition and features, recent comparable sales, and relevant market trends, and the resulting report is designed to withstand scrutiny.

An appraisal is distinct from a real estate agent's Comparative Market Analysis (CMA), a tax assessment, or an automated online estimate. A CMA is a marketing tool used to suggest a listing price, a tax assessment is generated for property tax purposes, and an online estimate is an automated calculation. Each can be useful for its own purpose, but none is a certified appraisal and none is designed to hold up in a legal proceeding the way a documented appraisal report is.

    Choosing the Effective Valuation Date

The effective date is the date the value applies to. In a divorce this could be the current date, the date of separation, or another date, depending on your circumstances. There is no single valuation date that applies to every case, so the appropriate date should be confirmed with your attorney before the appraisal is ordered. We can accommodate the effective date your counsel advises, including a historical (retrospective) date when appropriate.

    Documents and Information to Gather

Gathering a few items in advance helps us prepare an accurate quote and a smoother appraisal. Not every item below is required, and requirements vary by assignment, share what you have and we will guide you on anything else that may help. Please do not upload sensitive legal or financial case records through the website quote form; share those with us directly only if and when needed.

    • Property address and basic details , location, approximate size, and property type (single family, condo, townhome, land, etc.).
    • Effective date: the valuation date requested, if your attorney has advised one.
    • Intended use and intended users , for example, settlement negotiations, mediation, or court, and who the report should be addressed to.
    • Prior appraisals, inspections, or listings , any earlier reports or recent MLS history, if available.
    • Notes on condition, renovations, or deferred maintenance , recent improvements or known issues that may affect value.
    • Contact for your attorney , so the report can be coordinated with your case.

    How the Appraisal Process Works

Every assignment is a little different, but a typical divorce appraisal follows these steps:

    1. Initial consultation. We discuss the property, the effective date, the intended use and users, and your timeline, then provide a written fee and turnaround estimate.
    2. Engagement and scope. Once engaged, we confirm the scope of work, the valuation date, and any specific requirements from your attorney.
    3. Property inspection and research. We inspect the property and research recent comparable sales, listings, and market conditions relevant to the effective date.
    4. Analysis and reconciliation. We analyze the data, apply the appropriate valuation methods, and reconcile the results into a supported opinion of value.
    5. Report delivery. You receive a written report documenting the methodology, data, and concluded value, ready to share with your attorney.

Access, Separate Appraisals, and Report Use

Property access is arranged during engagement. An interior inspection is preferred when it is available, but if access is limited we can discuss what observation is possible and how it affects the analysis. Condition, renovations, and deferred maintenance can all influence value, so describing the property's current state, and any recent changes, helps us develop a more accurate opinion.

An appraiser can be engaged by one spouse or by both spouses jointly, and a single neutral appraiser is common, though it is not required in every case. If each spouse obtains a separate appraisal, the two values may differ because of a different effective date, scope, assumptions, property information, or comparable sales selected, the values are not automatically averaged to resolve a disagreement. Report distribution and confidentiality depend on the engagement and applicable obligations, so confirm with your attorney how the report may be used and shared.

    Factors Affecting Cost and Turnaround

Fees and timelines are not one-size-fits-all. They depend on the property type and complexity, the location, the effective date, and the availability of relevant sales data. A straightforward single-family home with good comparable data is typically faster and less costly than a unique property or a retrospective valuation date. After a brief conversation about the assignment, we provide a written fee and expected turnaround before you commit to anything.
